BiteSense terms of use
This is a draft awaiting review. It has not been checked by a lawyer, and the governing law and entity are not yet settled. Do not publish it as-is.
1. Who these terms are with
BiteSense is provided by Konbran, Needs your decision whose legal entity and registered address are not yet settled (registered entity name, address and country) . By using the app you agree to these terms.
2. The app gives estimates, not measurements
BiteSense estimates the contents of a meal from a photograph and from third-party food databases. Estimates can be wrong, sometimes substantially. You are expected to check and correct them. Nothing in the app is medical, dietary or nutritional advice, and it is not a medical device. If you have a health condition, are pregnant, or are being treated for an eating disorder, consult a qualified professional before acting on anything the app shows you.
3. Your account
You need an account to analyse photographs. Keep your password to yourself; you are responsible for what happens under your account. Tell us at support@konbran.com if you think someone else has access to it. You must be old enough to hold an account — Needs your decision the minimum age is not yet fixed (the minimum age, which must match the Play target-audience declaration) .
4. Fair use
Photograph analysis costs us money for every image, so there are limits on how much any one account or device can use in a day. Do not try to work around them, automate the app, or use it to analyse anything other than your own meals. We may suspend an account that does.
5. Your content
The photographs you take stay yours. You give us permission to send them for analysis and to store the result, as the privacy policy describes. We do not store the photographs themselves, and we do not use them to train models. Needs your decision Whether the provider that performs the analysis may retain or train on an image is governed by its own terms, which have not been reviewed yet. (LIFTOFF Gate 4: 'Third-party AI provider data handling reviewed'. Confirm the chosen provider's terms before stating this on their behalf.)
6. Food data
Nutrition figures come from USDA FoodData Central and Open Food Facts. They are supplied by those sources under their own terms, and we cannot guarantee that any individual figure is accurate or current.
7. Availability
We do not promise the service will always be available. Analysis and search depend on services we do not control, and both can fail. The app is designed to keep working locally when they do.
8. Ending it
You can stop using BiteSense at any time and delete your account — see Delete your account. We may suspend or close an account that breaks these terms, and will tell you why unless we are prevented from doing so.
9. Liability
Needs your decision A limitation-of-liability clause belongs here and must be drafted for the jurisdiction you operate in. (a lawyer must write this clause for your jurisdiction; consumer law limits what can be excluded)
10. Changes
We may update these terms. If a change matters we will update the date above and tell you in the app.
11. Governing law
Needs your decision The governing law and the courts that would hear a dispute are not yet settled. (the governing law and courts — follows from where the entity is registered)
